Welcome to Createe’s Design Collaboration Feature, where customers can partner with our talented illustrators to bring their creative visions to life. By engaging with this feature, you agree to the terms and conditions outlined below.

1. Overview of Service

Createe’s Design Collaboration Feature allows customers to work with our illustrators to develop custom designs or illustrations. Customers will have the right to use these designs as outlined in this agreement, with the option to sell them exclusively as prints on apparel through Createe's marketplace.

2. Intellectual Property Protection
• Customer’s Original Concepts: All initial ideas, sketches, or concepts provided by the customer remain the customer's intellectual property. By sharing these concepts with Createe, customers grant us the necessary rights to use them solely for the purpose of fulfilling the collaboration and creating the final design.
• Illustrator Contributions: Illustrators retain the rights to their artistic techniques and unique styles, but upon completion of a commissioned design, they transfer exclusive ownership of the final work to the customer within the agreed limitations.
• Final Design Ownership: Once a design is completed, paid for, and delivered to the customer, the customer holds exclusive rights to the final design within the Createe platform, including the right to reproduce, distribute, and sell the design as print on apparel within Createe’s marketplace. Third-party sales or distribution outside of Createe’s marketplace is strictly prohibited.


3. Satisfaction Guarantee
• Revision Process: Customers are entitled to request revisions during the design process to ensure that the final outcome meets their expectations.
• Refund Policy: If, after a reasonable number of revisions, the customer is still not satisfied, Createe may offer a full refund, provided the dissatisfaction is communicated before the final design is approved and delivered.
• Quality Assurance: All designs undergo quality checks by Createe to ensure they meet high design and technical standards suitable for printing.


4. Rights to Sell on Createe’s Marketplace Only
• Marketplace Exclusivity: Customers have the option to sell their commissioned designs as print-on-demand apparel exclusively through Createe’s marketplace. Createe will manage the printing, shipping, and handling for marketplace sales, with proceeds split as outlined in the marketplace’s separate seller agreement.
• Third-Party Sales Prohibition: Customers are not permitted to use the final design for commercial purposes outside of Createe’s platform. This exclusivity protects the integrity of Createe’s offerings and ensures quality and consistency across all sales channels.


5. Confidentiality

All information shared during the collaboration process is treated as confidential. Createe and its illustrators agree not to disclose any proprietary design concepts, business plans, or related confidential information to any third party without the customer’s explicit permission.

6. Limitation of Liability

Createe’s liability in relation to any loss or damage arising from the design collaboration service is limited to the amount paid by the customer for the commissioned project. Createe is not liable for indirect, incidental, or consequential damages.

7. Modifications to Terms

Createe reserves the right to update these terms and conditions as necessary. Any changes will be posted on the Createe website and will take effect immediately upon posting.

8. Acceptance
